The department offers full service corporate, banking and commercial cover and is able to advise on all aspects of Guernsey corporate and commercial law, including banking and finance, regulatory, investment funds, asset management and listings on The International Stock Exchange (TISE).

Each member of the department has worked at major offshore law firms locally, gaining valuable experience in matters of Guernsey corporate and commercial law, either for Guernsey clients or as part of transactions with an international exposure. We advise a broad range of clients with respect to protection of their intellectual property rights. In this regard, we advise on matters including licensing and royalties, trademarks, patents, design rights and structuring for the protection of intellectual property.

Our Dispute Resolution team acts for both employers and employees in relation to all kinds of employment disputes, including contractual claims, dismissals and discrimination.

Our Dispute Team has a wealth of experience in advising trustees, settlors, beneficiaries, protectors and third parties dealing with trustees.  We advise on both contentious and semi-contentious matters including in the context of mistake, the blessing of momentous decisions, hostile trust litigation and regulatory obligations.  We also have experience of pension scheme disputes and matters coming before the Channel Islands Financial Ombudsman.

The dispute resolution department at Ferbrache & Farrell LLP has vast experience of local and international litigation and dispute resolution generally, gained from acting in complex local and international high-value disputes, both in Guernsey and throughout the world.

All of the department’s advocates have practiced at top city and offshore law firms and together boast years of contentious, semi contentious and advisory experience. They have regularly acted for large corporations and high net worth individuals, and have appeared or been involved in many of Guernsey’s high profile law cases.

The Guernsey property department is dedicated to providing tailored solutions that meet and exceed clients’ expectations. In addition, the property department provides support to colleagues in the corporate and dispute resolution departments on real estate-related technical points of law.

The team’s areas of property expertise encompass sales, purchases, leases, licences, boundary issues, property development documentation, legal title and banking paperwork.

Our planning experience means that we are often called upon to provide strategic advice, submit planning applications, deal with enforcement issues and conduct planning appeals.

In environmental law matters, we regularly provide legal opinions and assist clients with minimising and managing risk.

For private client considerations, we assist with wills of realty and personalty, codicils and Guardianship applications, whilst for housing/population queries we regularly advise on questions relating to the new population regime.

The team has a deep understanding of the real estate marketplace and is alive to the importance of offering value for money. In most instances, a fixed fee pricing model is offered. With more complex or time-consuming matters, alternative fee models can be arranged.

We also have expertise in dealing with the most complex and difficult probate issues sensitively, quickly and efficiently. In addition to assisting local families, we also work with individuals, law firms and institutions from overseas who need to obtain grants of probate in Guernsey in order to release assets held here.
