Our Story

After working extensively in top and mid-tier firms in Australia and New Zealand, Martin, the Executive Director of Equitas Lawyers, became convinced that justice and legal services were not as easily accessible as they should be. He believed that top standard legal services should not only be available for the privileged few.

Martin’s vision was to build a law firm dedicated to offering top standard legal services at reasonable and affordable prices, for people from all walks of life and for corporate bodies of all sizes.

And so in 2008, Equitas Lawyers was formed.

Litigation and Dispute Resolution

Disputes can be naturally distressing. However, it doesn’t have to stay that way. Our litigation and dispute resolution team is experienced in litigation in all Courts of Western Australia, the Federal Court of Australia and the State Administrative Tribunal. We approach all clients’ disputes having regard to their commercial objectives and with the aim of achieving the best and most cost-effective dispute resolution outcome.

Whether a dispute is to be resolved through formal litigation, arbitration, mediation or negotiation we bring to bear our litigation and commercial law experience early on to identify key legal and commercial issues, assess the strength of our clients’ position and recommend a strategy and preferred method of dispute resolution.  

Examples of our experience include:

  • acting for plaintiffs in a claim for misleading or deceptive conduct in the District Court of Western Australia;
  • acting for a defendant in a debt recovery claim in the Supreme Court of Western Australia;
  • acting for a recipient of subpoenas issued in a matter in the Federal Court of Australia;
  • acting for a defendant in a commercial lease dispute in the District Court of Western Australia;
  • acting for an applicant in a dispute under the Commercial Tenancy (Retail Shops) Agreements Act 1985 (WA) in the State Administrative Tribunal;
  • acting for a mortgagee in possession in making a claim for moneys owed in the Supreme Court of Western Australia.

Our commercial law team has extensive experience on a full range of commercial contracts and focus on providing practical advice to address and manage key contractual risks for our clients.

We endeavour to take a plain English approach to preparing and reviewing contracts to ensure our clients' expectations are appropriately understood and documented in a way that endeavours to promote smooth ‘cost-efficient’ transaction negotiations and implementation. 

We advise on statutory issues, including obligations under the Australian Consumer Law, Transfer of Land Act 1893 (WA), Property Law Act 1969 (WA) and Strata Titles Act 1985 (WA) and Commercial Tenancy (Retail Shops) Agreements Act 1985 (WA) to name a few and bring this knowledge and experience to bear when drafting, negotiating and preparing commercial contracts.

We are available to draft complete commercial arrangements, comment on particular clauses, act as a sounding board, review standard form agreements for ‘key’ issues, or simply offer a second opinion on a particular agreement.

Our work routinely covers preparing and advising on a wide range of commercial contracts, standard form consumer terms and conditions, supplier and distribution agreements and licensing agreements.

We advise Western Australian and international clients on core commercial contracts such as business and real estate sale and acquisitions, supply, service, manufacturing, reseller and distribution agreements, as well as standard terms of trade and customer terms and conditions.
